My son is 7 years old in the first grade and most children this age are full of energy and he is usually a well behaved child. His teacher is trying to quit smoking also - but I don't think pinching him was appropriate. Aren't there laws against this type of behavior?

I did speak with the teacher and she said he was moving around in his chair and not sitting straight or listening when she told him to sit straight. And it is a Catholic school so what does that mean as far as it being acceptable?

I don't know if it's illegal but if that happened to my child I swear to God, there would be you know what to pay. I would go straight to the principal & demand an apology. That is completely unacceptable.

Why aren't you more concerned about what your son did to get pinched. "Usually well behaved....", what does that mean - he's good all the time except when he's being bad!
Have a talk with the teacher, if you haven't already, find out the details of the incident and be sure she understands that a repeat performance is unacceptable. Make sure you son understands that his behavior is not to be repeated too.

Firstly whatever school ur son attends makes no difference to the behaviour of a teacher. No one has the right to pinch a child and this is totally unexceptable in the teaching profession. Sometimes if a child will not do what they are told a teacher has the right to take his/hand and sit them down. If a child is say being violent he/she can be restrained which each teacher knows the procedure and understands fully. If you are concerned about this matter i suggest you make an appointment to see the headmistress/headmaster and make your feelings known. In the defence of teachers nowadays we are seeing alot more behaviour problems, which in turn affects the learning of not only them but others. T eachers hands are tied but as soon as their child is not making progress or getting good results parents will be the first to complain. I personally believe that children should understand that within schools this kind of behaviour is unexceptable. I believe every child has the right to learn and every child matters. So parents have a responsibility towards childrens beahviour and teachers have the role of teaching. Please speak to the head of the school if this issue has upset you and find out what exactly happened as children can sometimes elaborate. Hope you find some solution to your problem.

Dunno where ur from so don't know about laws, but it certainly wasn't appropriate!!!! It doesn't matter that she's trying to quit smoking or whatever is happening in her life, she has no right to touch her students in anyway that MAY hurt them- if it hurt your son then you shouldn't be worried about going to a higher authority, or maybe somesort of parent commitee. Your only worry is it coming out as a trivial matter on your part. "Pinching" is neverthe less harsh and should never be brought upon a child....even if he was being naughty, the teacher should know better than to resort to physical matters to deal with him...all the same, tell your son to be a little nicer to the teacher and not provoke her in class.....

I wouldn't complain to the princpal, but yes there is a law against this kind of behavior he could get fired.
They need a parents consent to do coropal punishment.
Just talk to his teacher as long as he doesn't do it again...if he does then....
But i understand quitting smoking is very hard. Friend tried to and he acted weird for a while.And ate tons of peanuts and gum.

Depends on your state. I would set up a meeting with the teacher and ask her point blank what happened, if you feel it is shady then contact the prinicpal.
All teachers lose their cool at some point. Discuss with your son that his teacher may not have behaved in the best manner, but remind him what good classroom behavor is and maybe even play school him so that you can praise him in his good efforts to ensure that he doesn't act out either.

I would definitely talk to the teacher about it to see what the school's policies are. If she is not receptive, then go to the principal. The principal should be able to handle the situation if the teacher is at fault. Just show the teacher some respect by talking to her and the principal about the matter, instead of letting rumors spread around among other parents.

Regardless of what your son did wrong, his teacher had absoloutely no right to pinch him! There is no excuse that makes this okay, and if I were you I would report it to the principal of the school immediately. This was an illegal move on the behalf of the teacher and needs to be addressed in a timely manner.

Hmm....it depends on which state you're in. I teach in Mississippi and corporal punishment is allowed. It is inflicted on all children, elementary through high school. They paddle the kids when they're "bad." I don't approve of this form of discipline, but it is used, and it is legal in Mississippi and in a couple of the other deep south states. Do you live in the south?

not to say that your child isn't sweet or kind, but some children do deserve a little "prompting" to get their point across...
now if the pinch left a huge bruise or broke the skin...that is another issue.
