The only way you can get a divorce without the others consent or even signature is if you 2 have been seperated for 2 or more years. I know this, i had to wait until my 2 year date, and as a matter of fact, mine is final in 2 weeks!!! YAY

Yes i believe you can and this is very sad and should not be happening as both parties should agree to it to make it valid or legal. HOWEVER i want to make on think clear to me if a person is badly abused or the kids are being abused or in the case of abandonment than only one party should have to agree and sign to it to make it final and legal. I think however that it may be more expensive and take more time then a regular divorce where both parties sign and agree but i am not sure... A divorce attorney could tell you more.

Yes you can. I have a friend who did not see his wife for 2 yrs she refused to sign the papers. It took longer then the "typical" divorce but the courts can not force you to stay married if someone chooses not to sign. I can't remember what it is exactly called but basically he went to court it was explained to the judge she refused to sign and the divorce was granted she was then sent a copy of the official divorce decree

The answer to this question varies by state. Different states have different legal requirements. Generally speaking, yes its possible to get a divorce if one person refuses to sign the papers. Yes you can. When on spouse has the other spouse served, the other spouse has a certain amount of days in which to "answer". If the spouse does not "answer" within the alotted time a defult judgement of divorce is handed down. (That's why I always tell the person filing for divorce to put in it that you want EVERYTHING if they suspect their other won't answer...if it because a default judgement winner gets it ALL)
