pay CS and he lives 1 and 1/2 down the street. I am married to a wonderful guy and he loves my baby like his own. The question is that he(sperm donor) and I are on disability. We both get the same amount. So what will he have to pay "if" I take him to court. OH OH he works under the table. I would think he is making over $500 a month on the under the table work. And I do have picture of his car being at the "work".... HELP!!!!!!!!! My husband will adopt my baby, but not right now...

He does not come to see the baby. When we are out and sees us.... he like all over him.

He is not a REAL sperm donor. He was someone I was having a relationship with. He was so thrilled when I told him I was pregnant and when I was 2 months pregnant he left me for his ex-girlfriend.

If your ex is on the birth cert then your husband cannot adopt without a fight, also, you didn't say if there was a support order, if there's not then you can't make him pay without taking him to court or letting the government take him to court, there is a formula that they use to calculate cs. It involves both incomes and whether there are older children, health insurance, and visitation. Also, the courts can't set that amount based on "under the table" income that they can't prove, and they don't care to prove it, they have a minimum and it goes from there, but it has to be verifyable. a stub, or W2.
***ALSO I DISAGREE WITH LOKISHADO, WHEN A GIRL GETS MARRIED IT DOESN'T MEAN THAT THE FATHER IS OFF THE HOOK. HE PAYS CHILD SUPPORT UNTIL THE KID IS 18 YRS (25 IF THEY GO TO COLLEGE). IT DOESN'T MATTER IF THERE ARE 2 INCOMES OR 4, HER'S IS THE ONLY ONE THAT MATTERS UNLESS SHE STAYS HOME THEN THE HOUSEHOLD INCOME WOULD BE ENTERED INTO THE FORMULA FOR CHILDSUPPORT. HE WOULD STILL HAVE TO PAY THOUGH.

As I understand the law, the sperm donor is not responsible for the well being of the child. You wanted to get pregnant. He donated sperm so that you could. He cared enough to help you get what you wanted, and he probably got paid for it. He provided a service. His obligation ends there.

Now, if he's not a donor, and the two of you (the donor and you) actually slept together and the result was a child, then he is responsible for the child's well-being.

But, if he's just a donor, then chances are he either donated sperm as an act of kindness (so you could have a child), or because he was paid to provide it. Either of those obviates his responsibility for the child.

Sorry. I can sympathize with needing extra income, but the child is your responsibility. Furthermore, married women are not usually entitled to child support (IIRC) from the biological father, the reasoning being that, since the woman is married, there is a second provider in the household.

Being married has nothing to do with child support - only alimony guys. And the new husband isn't adopting until they find out if they can get money from someone else. You probably didn't even care until your "wonderful" man said "HEY - we could have more money" and you have since agreed it would be an easy way out. Why are you on disability? I have a problem there, too. Get a job.

With him on Disability, and him being paid under the table, unless you can prove that hes actually being paid at this other job, not sure much you can do except talk to a Lawyer. This man can always say hes just visiting this other place, if hes being paid in cash. Most people on Disability do not collect that much from what i hear. Good Luck to you..

wouldn't be great if he really was a doner !!! LOL i think that all the time.... i say take him to court make him give you something...even if its just 20... its something my ex was on benifit to and i got 50 from him through the courts.. its tough though dont get me wrong!!!!

if your new partner is so good.. why dont you just pretend the sperm doner did not exist and live like a happy family and dont let your ex have anything to do with the child.... i have had thought of that before i went to court i would be so much happier now..

You should expect that if the sperm donor, as you call him, has to go to court over this, he will not pay much as he is on disability, he will get visiting rights and he does not have to sign adoption papers. He can have his car where ever he wants, thats a hard thing to prove or he could quit, saying its too much for him and you get p i s s all, which is what i think you deserve.

If you really need the money from the "sperm Donor" then take him to court and the court will take care of it. BUT make sure your not one of those mom's who say then need it for your baby and use it on yourself. (I really hate people like that) and if you don't really need the money than leave it be let the man be a dead beat father.

If your "donor" is on disability, the child can collect disability under him. Just like child support. You will not get rich off of it, but you shouldn't hope to. The child can collect until he or she is 18.

Oh.. I know the situation with the donor.. I call them that too...lol... anyway. He will have to pay appox. 20% of his diability to you each month. The under the table work cannot be counted. He will not automatically get visitation, he can file for cusody/ visitation and what he gets will affect the amoutn of payment you will get... Good luck.. keep that man you have, it takes a great man to raise another mans seed

I do feel bad for you but I truly feel like you used this guy to get pregnant with no strings attached and now you are going against your word. If the guy who is really the father wanted to be in your life he would!!!! move on and leave this guy in your past!!! he did you a favor and leave it at that! get on food stamps and section 8 and lose the loser that's in your life.
