Back in the mid seventies the U.S. Supreme Court ruled that it is not illegal to tape a conversation providing that one person consents to the taping and according to the Law, you can tape a conversation if you give yourself permission to do so.

Also, it is not illegal to tape a conversation if it is in conjunction with a Felony. In other words, you can tape a conversation between two people conspiring to commit a crime without their permission.

It depends somewhat on your jurisdiction. Here, you can tape your own phone, but not that of someone else. If you tape your own phone, you do not have to inform the other person. In some jurisdictions, it is illegal to even tape your own conversation unless the other party is made aware.

If you will call your local District Attorney, they will probably be able to tell you about your county or state.

right it is what the regulation says in CT: "Conn. Gen. Stat. § fifty two-570d: this is against the regulation to tape a telephone verbal replace in Connecticut without the consent of all events. Consent might desire to be in writing or might desire to receive on the recording, or a verbal warning that the verbal replace is being taped might desire to be risk-free interior the recording." CT is a state that demands that the two events of the verbal replace observe and consent to the taping. in case you probably did no longer advise your neighbor which you have been taping the verbal replace previous to recording it then you definately may well be in a nicely mannered way responsible for damages to your neighbor. The tape isn't admissible in court docket. i could propose destroying the tape and not pointing out it to anybody.

Both parties have to know that the conversation is being taped, unless it is done with a warrant - then anything goes.

very legal. Can it be used in a court of law? Dang right it can be and has been. Divorce cases, 911 calls and harassment are just a few that people have taken to their lawyers. Computer (Internet) exchanges are even being used in courts today to catch criminals.
