a friend of mine was working for a company. She left the company, and 1 week later the pay for the month went into her bank account ($2000). about 6 weeks later they rang her up asking her to pay about $600 of the money back because they realized they had overpaid her cos she finished in the middle of th e month. The monthly payment is for 2 weeks in advance, and for the previous 2 weeks.

1. Should she pay them back or is she entitled to keep the money?
2. What if she already spent the money?

she is not entitled to keep the money. it is not her money. it was just a mistake - and she knew it.
even if she already spent it, she still needs to pay it back. she may be able to work out some sort of payment plan if she cant afford to pay it all off at once.

they will be able to take action against her if she refuses to pay it back.

If she wanted to do the right thing she would go back and tell them, but I can gaurentee you this is not the best place to ask that sort of question. Very few people are going to say go back, most would just ignore it and keep the free money.

They will garnish for the return of the money, they will get it back one way or another.
