We pulled our daughter out of her daycare following the provider having roaches in the kitchen, not following our orders (not putting our daughter outside on extremely cold days with a runny nose), and requiring us to medicate a runny nose that doctors and pharmacist said to let run its course untreated.

We had 2 heated discussions with thte provider with no positive results, she was absolutely unwilling to work with us. So we pulled her out as soon as we found another provider.

The old provider sent us a letter demanding her last 2 weeks payment per contract...however I don't feel she is entitled to the payment, because she didn't fulfill her end of the contract or look out for my child's best interests. If I don't pay her she is claiming to take us to small claims court ($200 owed payment)...Should I pay her or fight it?

Personally I would fight this. It may be hard to prove if you have nothing to show for evidence but in small claims character can go a long way. From the informaiton you have provided here I say that you probably have a pretty good shot at winning. Hope it works out for you.You made a good decision in taking her out of there!

read the contract. It probably states what $$ is owed if you pull your kid. It doesn't likely state any conditions under which no $$ would be required. An excellent contract for the provider...but not really helpful to you.
You can suggest that perhaps Child Welfare would like to discuss this matter with provider (especially with the roaches situation). That might shut the provider up.
Or you may take your chances in court. Unfortunately, if you signed the contract, you may be legally obligated to pay...even though it's a terrible rub.

Write her back and tell her that if she will forgo the $200, you won't report her to the Licensing Board for the roaches and mistreatment of your child. That'll shut her up.

I would fight it. Knowing the conditions of her house I have to ask How did she get a daycare license?
