Depends on the state. Texas does not have legal separation. You are either married or divorced. If you are legally separated, or have filed for divorce, everything is sort of frozen. You cant liquidate your assets, empty out your retirement, sell the house, ect. These are the things that will have to be divided in the divorce. Also, if one party goes out and starts racking up huge amounts of debt, the other party is not responsible for that debt like in a normal marriage.

Separation is not intended to be a permanent thing. It is a temporary status one takes before either getting divorced or reconciling.

In a legal seperation you still have to divide everything you own 50/50.
