yes, the copyright law is being infringed upon. The music industry is aware of this and are trying to ensure that YouTube does have to buy a licence or does something to prevent unlawful use of copyrighted music. It is going to be an interesting fight. It will take some time to actually happen, as talks are only just beginning but I am sure there will be some more tough punishments coming up at some point.

I believe if it has a copyright you cant use it unless you receive permission from the copyright holder. Just because you don't make money doesn't make it legal. What if someone used the song in the background for a free porno i doubt the owner of the song wants that type of use.
