You will need to speak with a family lawyer and see what can be done if the father has been out of the picture for this amount of time theymay just allow your hubby to adopt her you will still go in front of a judge and she will then take his last name that is usually how it works.

You need a lawyer to get the ball rolling. If your daughter's biological father is nowhere to be found, then a notice will be put in your local newspaper addressed to your daughter's biological father. He will have so many days to answer your husband's request to adopt your daughter. I'm not real sure but it seems to me that if there's no response to this request, then the adoption will go through the court, after a sensible waiting period has expired. A lawyer can tell you best about this.

Some states, after the father has had no contact for 1 year, thats abandonment, and the child can be adopted.
My ex-husband never tried to be a part of my daughters life, and we didnt push adoption or anything like that...
But....my daughter used to cry to be adopted from her stepfather, for he is the one that has been there, and never left her side..her father has let his wife influence him and walk out on her...
Even though she is not adopted...You wouldnt be able to tell it...he is her DAD, nothing said...He is her HERO.
Usually just depends on your state, see if there is the abandonment law, or if he has to sign over his rights, alot of men will, just so they wont have to pay child support...l

You must prove beyond reasonable doubt....and you must try to find the biological father to ask him to aleve all parental rights. However, there is an easier way to do this.
If you go to a notary public and sign an afidavit stating you cannot find the biological father and that you have tried to do so by every means possible....take that note and proceed to a lawyers office and take it to court.
i know this because I almost adopted my late wife's teenage daughter.
Not gonna tell you that it is cheap because it isn't. But, I am sure it will all be worth it.

The first thing that maybe you do is to talk with someone at DFS, maybe they can give you a place to start, or ask her biological father to sign over his rights so that your husband can adopt her . Been where you are.

Get in touch with an attorney and have the papers drawn up.
It is sad that the child's father does not want to be in their life, he will regret it later. Time will not wait for the sperm donor to pull his head out of his butt. This child has a loving father now.

I beleive you would go to a courthouse, to get some documents and they may ask for a couple things, and then i think the next step is your may have get proof that the real father isnt involved, even in a finacial respect and your husband is the sole provider (FATHER ) wise.

Get an attorney,he will run a check in whatever known state your ex was last in, If he is not found,the attorney can most likely proceed with the adoption.
