Identity theft is a criminal offense. This person could go to jail if you report it to law-enforcement. You can also sue in the civil courts for all and any damages that resulted from the identity theft.

You have a right to bring a lawsuit against any person for a reasonable cause. People that go to court have exhausted all means to communicate and must pay an attorney to represent them. You should consider asking for a settlement from the person and you get it all.
