My upstairs neighbors are very active throughout the night and I am constantly losing sleep over the amount of noise that they make. The last three times that I have complained about them the property manager has assured me that the next time they receive a complaint on these tenants they will be evicted. I've requested to be released from my lease because of their lack of action. How do I get results from this person?

I've gotten several responses to call the police, which is a good idea. The biggest issue that I'm having is that these tenants are having...well...very loud sex. More specifically I'm hearing the bed rail banging against the wall. By the time the police would show up they would be finished and I would be wide awake.

Depending on where you live, there may be a renters sort of like union where you can get help. Even if your landlord says they will evict - it takes quite awhile to go through court to do so. It can be many months and the reason has to be good. You can try talking to your neighbors or start calling the police if that doesn't work. A few visits and maybe tickets from the police may be all that you need.

Call the cops on your neighbors. Take the police report to your manager and tell them something has to be done or you will consider it a breach of your lease. Put this in writing. Next time you call the cops, you give them notice that you now consider your lease null and void, but will pay through the end of the month, at which time you will be vacating the apartment. If they seem to have a problem with that, contact the Housing Authority, or similar agency, and/or take them to court. Or really, you'd just have to threaten to take them to court and they would back off. Be sure to get it in writing that they recognize that your lease is no longer enforceable due to their negligence.

most states have a 10 p.m. noise regulation, If it is after 10P.m. when they are making the noise call the police, instead of the landlord. You keep putting the cart after the horse.
