How about this- " Neither the First Party, nor the Second Party shall have any liability for the failure to carry out any of their obligations under this Agreement due to any cause or causes beyond their reasonable control, or not caused by any error or negligence on their part, such circumstances herein referred to as Force Majeure, except for any obligations that may arise subsequent to the Force Majeure"

you could just leave it out. The sentence is pretty wordy and tough to decipher as it is, and "beyond their reasonable control" sort of implies that it is not caused by their own mistakes. If you do leave it in, it's marginally okay in terms of grammar, but the meaning would be clarified if you change "and" to "which." Condensed, the sentence would read, "The parties won't be held responsible if they fail to carry out the obligations (specified by this Agreement) because of any situation outside their reasonable control *which* aren't caused by their own mistakes."
