I have a friend who told me her landlord decided he wanted to sell the house she was renting before her lease is up. Is this legal? Can he just kick her out?

Well this is a area that is quite clear..
If the landlord wants to sell then he can , but he has to get a legal order to break lease enabling the tenant time to find another place , say for example he gave them 90 day settlement on purchase of house then they (renters)will have at least 90 days minimum notice
I'm pretty sure the minimum is 90 days notice....Of course this depends on where you are ,and what the agreement is written into the lease contract....Seek legal help(for compensation) ..♥

It depends on the lease. Most leases that I have had on rental contracts had a clause in them that stated in the event the building was sold, the landlord only has to provide 45 days notice of the sale before the lease is terminated.

Been in this situation. Provided the landlord is selling to another property developer then there shouldn't be a problem. The lease or rather tenancy agreement should be honoured. If the landlord want's a sale to Joe Public then it's a rather different ball game. Time to read the small print on the tenancy agreement.

Landlords are usually allowed to sell the property, even before the lease is up. The new owner must honor the lease for the entire lease term. These are the general rules - you will need to check your lease term for specifics.

No, but he can sell the house. The new owner would be her new landlord. She cannot be asked to leave, but it might be a time to do some bargaining. Moving expenses, etc. But, the bottom line is - and in spite of TV or movie themes - a tenant still has the right to the terms of the lease.

there is nothing to stop the landlord selling the house at all, and just because he is selling does not mean she will be kicked out.

Check the lease details.

If it's a short lease the landlord probably only needs to give 2 months notice anyway, which is as long as it takes to sell a property.

She has a contract. I would think if the Landlord was to break the lease then he would have to pay some sort of penalty. Same goes if she was the one to break the lease. I would have her call a free advice law firm if she wants to per-sue it and see what they say.

not unless it was written in the lease that the house could be sold, voiding the contract. Your friend needs to read the lease and make sure that she hasn't done anything to violate it because he can also cancel the lease if she violated the contract. Otherwise, contact an attorney.

No he can't just kick her out but he can get permission from her or a judge or someone to end the lease but he'd have to compensate her for the time left on the lease, moving expenses, etc.

Probably not. Unless your friend has broken the contract in some way, she is entitled to continue renting the property until the lease expires.
