When I went to jail my nephew said he would take care of my Dad until I got out. Well my Dad is very old and can't remember things that good.
So what my nephew does is puts him in a home and has him sign the house over to him. My dad is still alive and I am out of jail. I want to know is there anyway I can get the house back?

If you can prove your father was not mentally competant when he signed you may have a case. Get a statement from his doctor saying that and then take legal advice on placing a caveat on the house preventing it from being sold or demolished. When it is all sorted make sure you arrange to have the little punk's *** kicked from one end of the country to the other ... I know some guys ...

You don't need a lien. You need an atty to prove your father was acting under a diminished mental capacity when he signed the house over or that your nephew comitted fraud.

Yoou'll never solve this without an atty and a lawsuit.

You can but you need to speak with a lawyer. If the lawyer thinks there is a valid law suit possible they can file a notice that will cloud the title on the home. It will indicate there is a lawsuit pending so the home can not be sold without the suit being addressed.

This is not something you should attempt to file on your own.

There is a legal forum on the site below.
