As far as the time you can see it, it just depends on how the sun hits it (since the moonlight is actually sunlight that is being reflected off the moon's surface). It all depends on angles of where the moon is in relation to your position on the earth and the sun's angle to the moon at the time you look for the moon.

I'm not sure about why it shows up in different spots in the sky, but I would guess it has something to do with the fact that the earth is tilted 23 degrees to the side. But this only would change the your position relative to the moon if the moon revolved at a different angle than 23 degrees (which means if you were looking at the earth/moon from far away the moon would be traveling exactly perpendicular--crosses the earth axis at 90 degrees). That is the only guess I could come up with for this question.

But as far as the time it shows up I do know it has mostly to do with angles from the sun, earth and moon in relation to each other.

This is a very simple explanation.

Earth days are 24 hours long.
The moon orbits the Earth in approximately 25 hours.
So every day the moon rises almost 53 minutes later. It's not going to be in the same spot in the sky at the same time every day because it's just not on the 24-hour schedule. It's on the 24 hours and 52.8 minutes schedule!
