I would go with "not to use" because standard grammar instructs us not to split infinitives. Saying "to not use" splits infinitives by putting a word in between "to" and "use."

This is really just what a bunch of scholars decided to make "standard proper English," and if you weren't writing a LEGAL document, but rather a letter or story, I would just say to use whatever phrase sounds most natural and makes the most sense when you read the sentence. But, legal documents should follow prescribed standardized grammar.
