I passed a criminal check and drug test with this company but I had a gap in my employment 6 years ago in 2001 for about 4 months that my company said they could not account for.

Do I have any options here? Can I file a lawsuit? Discrimination? Unemployment?

Why would the company keep me on for 4 months before firing me about something that happened in 2001?

I still have not received any literature or "walking papers" from the incident as well.

Please help! Thanks all!

I don't know about the legalities of your situation, but I do know it is always better to be upfront about any gaps in employment.

Where were you for those four months?

I don't understand how they can fire you just for having four months unaccounted for, unless you lied and said you were working somewhere during that time.

You probably won't be able to do anything-- an employer can fire someone (at least in the U.S.) for any reason they wish, especially if you are employed during a "probationary" period under six months.

It would cost you more money to pursue this and you should just let it go.

what you need to do is read your company's policies regarding this sort of thing.

if there is a stated policy that according to the rules of the company they can let someone go for that reason, then you have nothing to base any legal action on.

if they don't have that as a stated policy, then you might get some traction out of it.

you would need to phrase it in a specific way - for instance, if your ancestors are from a different country, then you could say that you suspected that as the true motive for being released...

Are you kidding? Companies can fire you because they dont like you, because you pick your nose, or walk funny. Its called "at will" employment - and you probably fit in that category.

"discrimination" in your context means firing you because of age, race, religion, etc. This doesnt appear to fit your facts.

Plus, your facts seem suspicious. You sure you didnt you leave out anything?

i would apply for unemployment anyway and see if that goes through...what can it hurt all they can say is no...and give you the reason why...will be more to work with when you see a lawyer if it comes to that.
