Because the laws were created by politicians. Common sense went out the window a long time ago. That's why dangerous criminals get out of trouble on technicalities and why people get millions of dollars for a minor injury.
Our system is horribly broken.

Nobody wants to get punished for doing a wrong thing. Hence people are ready to pay any price to any one to get out of the clutches of law. Settlement of cases in courts takes days and years. A common man cannot devote that much time at the cost of his livelihood. The procedures in courts are so cumbersome that no ordinary person can fight a case on his own. The advocates charge hefty some for fighting cases in the courts with no surety of success. A conviction can be prolonged by appealing in higher courts for which a lot of money is required to be expended, which is beyond the capacity of a common man.

Any citizen of India can fight his own case as a Party-in-Person. The only problem that comes up is that for your own case, you will be involved in it passionately and sometimes that passion which flows into emotion will have a negative and wrong effect in in a court of law. Courts ordinarily do not encourage a party in person due to this reason. The other aspect is the knowledge of law. Law requires immense study, of course not to the extent of engineering and medicine but yes study is required. Thirdly, when coming to the trial, a great amount of knowledge of law, dexterity, skill and rhetoric is needed to prove your case. This comes through practice and experience.

need legal expertise in court.
it's like saying why can't the common man lay brick
or why can't the common man develop software in c language.
you must learn the profession or skill to deal with the
peculiarities of the court system. it's a specialty.
so you need an attorney.
most of the cases are probably traffic violations and the person charged is guilty and knows it so there's no point in fighting.

There is nothing stopping the 'common man' from fighting cases in court. That is, unless the judge rules the person not competent to defend themselves.

Because you can't really fight unless you know the laws and how to research them and case law.
That's why people pay the money they do and spend the years they do learning that stuff in law school and as law clerks under more experienced attorneys' wings.

sad to say most lawyers know the laws but lack any form of common sense and do not care about the case just bottom line as to how much they can make from it and if your paying if you can afford to pay them or if you need to sue if other party have big deep pockets if not they say BYE so very quick

You are right. I as a bank employee with the SBH for 21yrs could not file a case against the bank because of courruption, prejudice, incompetent offices here. I have not got justice.....
