the company i work for have said no one can take time off for the whole of december is this legal?

Yes, they can - and many do! During peak seasons (Christmas time in retail, tax time in the financial industry) the manpower need mandates that everyone be on board and available. Most of the time you are aware of this as part of your indoctrination into the organization, but occasionally the need develops quickly....you can, of course, use your sick time...

This is perfectly legal, although a reasonable company will probably allow leave if there is a genuine need for family or personal reasons.

I work in finance, and my particular employer will not allow holiday in December or January, and its like getting blood from a stone to get holiday in November, February and March as well.

And, whoever mentioned the 48 hour limit? well, I've done 70-80 for many weeks, it just happens.

Its just the nature of the job in my case. You should check your contract and any other formal notices from your company, as long as they've given you a heads-up, its fine.

Yes! They can say this and more! Depending on the type of business, whether it be retail, hospitality, or in finance, there may be other times of the year that you may not be allowed to take time off. It's the nature of the beast! Of course they should explain this to you at the time of hiring so you can make a choice whether you want to work for this company or not! Good Luck!!

YES: The company authorizes time off at a time that permits the company function. If you want time off when the company want you to work, the work contract states that you would be replaced on a permanent basic.

Lots of companies don't let you take leave in december, especially in hospitality and retail. It will probably say in your contract or handbook that your holidays must be at times convenient to the company and if December is their busiest time they're within their rights to not allow holiday.

I work in retail and we are not allowed holidays in the busy time of the year which are of course, christmas and easter. It states in our company handbook and when we sign the contract on taking on the employment we agree to this. Nothing you can do about it if its part of your company's policy.

I work for a firm of solicitors and we have been told that we cannot take time off in December unless it is our main holiday and that next year we HAVE TO take 4 of our holidays to cover the christmas break !!

Check your Contract of Employment - I'm almost 100% sure it will state something like "You are entitled to XX days Holiday per year to be taken on dates agreed with your Manager"

At my last place, my Manager was so good at refusing to allow me to take Holidays that almost every year the Company had to make 'payment in-lieu' for days I was entitled to but had not been allowed to take !

depends on company I have known of some that put it in your contract or it is stipulated, if it is the busiest time of the year for them I think that they can get away with it
