We are going to Florida in november (live in the U.K) and was told today that i may need my son's father's permission to take him.

He hasn't got parental responsibility as we weren't married and we have never been through a court process for anything.

Can anyone tell me if what i was told is true?

Do you have any kind of a legal parenting document? It sounds like you don't.

In the United States when you divorce a document is set up which states how you can go about taking your child out of state/country. Generally it simply states that you must notify the other parent in advance by at least 2 weeks. Since it sounds like you don't have any such agreement, double check with a solicitor in the UK just to be sure. Things that might affect this are if the father has parenting time with the child, and if he is listed on the birth certificate.

No one has ever asked me to show I had permission to leave the country with my child - but it might be asked on the passport application. You might have a problem with the father when you return if he wasn't notified so double check with a real professional, not unknown folks on Yahoo Answers.

Depends if he is an active part of the childrens life and or pays support if so then yes he has a say if not then he doesnt.
