I need to present my arguement from a legal/case law stand point, but can find very little modern information that directly addresses this issue especially in light of civil rights legislation. Help? Just put me on the right tract.

Well, it's just about what's considered indecent exposure in our culture. Men's nipples aren't considered to be sexual, and therefore are not obscene to look at.

There was an equal rights amendment, proposed in the 1970's and finally died in the 1980s. It got defeated because the Supreme court would probably interpret things like that in a strange way. (that's for the USA)
