I need to present my arguement from a legal/case law stand point, but can find very little modern information that directly addresses this issue especially in light of civil rights legislation. Help? Just put me on the right tract.

Men and women are different. Men do not have mammary glands; women do. Bring a biology book to class!

Our law recognizes some differences between men and women. Single-sex restrooms are legal, even in government buildings, whereas racially segregated facilities are, and should be, illegal.

Can I sue a gynecologist for failing to examine me? I doubt it.

Also, how would this law work in connection with the sexual harassment laws? If I hire some men and some women in my office who like to go topless (and don't pay them extra to do it, which is one of the limitations of the New York law), then does any other employee who objects have any right to sue for sexual harassment because I have created a "hostile work environment"? If, so, how does that square with the "equal rights" toplessness law?

That's a start. Good luck.

The first thing that you have to consider is where is this topless woman? Each town has their own laws in regard to public nudity. Research the origins of the law in that town. You will probably find it stems from a religious group or person. Also research history during the Victorian Era in England. Your talking about beliefs that were established centuries ago.
