Can elementary schoolteachers e-mail kid's performance to their parents who are out of the country?

As long as they have custodial rights, then yes you may. If someone else has custody and they do not want you to inform their parents then you may not.

The leagal guardian of the child, no matter where they are in the world, should be able to receive their child's performance updates via e-mail.

Melaine L. is correct or unless the custodial parent (guardian) gives his/her permission in writing.
