my boyfriend is claiming to be common law married to him - we are not - we don't meet the requirements only lived together and own a home....that's all - nothing more.....never held ourselves out as a married couple - he and i both filed a return in 2005 as HOH -separate returns and claimed our own children - we don't have any together....i found out just a week ago that he changed his return to Married and claimed me and my son - i never signed anything nor gave him the right to use my SS# and my son's SS# to which my son is a minor........can he do this without proof of a marriage certificate and against my will as he did not have my permission.

No he can not do this
it against the law,if your son live with you and you took care
of him you can,if your boyfriend took full care he can
but it is against the law to use someone else Social Security
Number without them know it. That happen to me once
or twice I don't know who those people was but they use my
social security and getting money from my ss# that I put in during the years I work. Please check on that number before it too late and when you get older you many not have anything to retired on.

You need to talk with a lawyer quickly. If the IRS makes an issue of the discrepency between your tax return and his, you could get in trouble.
By the way, many states no longer have common law marriage. In some states that passed a constitutional amendment against gay marriage, the amendment also ends common law marriage. You should look into this too.

when did you live together? If he didn't support you, you better report it and quick. Otherwise you could be in big trouble.

Common law comes from living together, and it doesn't require a marriage certificate, but it doesn't exist in every state. Better clarify with local authorities.

If you're common law married though, you can sue him for divorce and take half of everything he has. Of course, if you have more money, you better contest the common law nonsense.

I see a lot of lawyers mentioned. I prefer the direct approach. Fill out your return just as you normally do, claim what you normally claim. When the IRS gets the returns the duplicate SSNs will flag them. At that point there is a fair chance that you both will be asked to speak to an IRS rep.

At that point, assuming what you have said is correct, he will garnish a penalty and you will get your return.

He screwed you out of your return probably.If he don't give you your part of the refund I believe I would call and get him an audit.Good luck on getting what your supposed to get.I never did get my money back.I see many say call a lawyer.Well lawyer/s are cool when your in trouble.I would call the IRS,then he will need to call a lawyer.
