Last Friday my husband made a deposit in our checking account by using the drive through. Made it after 2:00 p.m. and I assume most know the rule that it does not go through until Monday. So I check my account late Monday night to see if deposit went through and it had not. So I check again Tuesday, they made the deposit then withheld the amount of my husband pay roll check. I receive a letter on Wednesday stating that the check was not in my enclosed deposit that it was missing. On Friday after making sure the check was not around I called my husband's employer and got telephone number to call and see if check had came back. Well it had. So I had them submit a copy to my bank. Well now the bank is saying the check was cashed and cash was gave back to us. Our copy of our deposit ticket says we deposited xxxx amount and now the bank is saying that was wrong. Is the bank liable to deposit the amount that is on the copy of the deposit ticket>?

The deposit receipt we have is the one that the bank gave us after the deposit had been made and has the correct amount. After the deposit went through the bank went in and debited our account for the amount of the check that was suppose to have been missing. This was my husband's payroll check. I had the canceled check copy sent to bank but still have not received my money back. Now they are saying the check was cashed and money was disbursed. Even though on our deposit receipt it showed only deposit made no cash back. Think I will contact FDIC.

If you have a copy of the cancelled check, and the deposit slip, this shouldn't be a problem. Speak to the branch manager. If he doesn't resolve it, ask for his boss's name and number.

You said "Our copy of our deposit ticket says we deposited xxxx amount". Are you referring to a copy of the deposit ticket that your husband filled out when he deposited the check? If so, you need to ask your husband for the deposit slip that the bank gave to him when he made the deposit.

As Quixotic said, if you have a copy of the cancelled check and the deposit slip you should have no problem getting the bank to correct the error.
