I think a few people missunderstood my question and the reason why it happened. So let me start again. I have 2 sons, one I pay support on and one I have custody of. They are by 2 different women. I was laid off for a while and my child support got behind. I did the best I could on unemployment and odd and end jobs. I recently went back to work and am trying to catch up on my support. The attorney general garnished my bank account. No problem. I made arangements with them to get back on track and start paying regular. Before my next payment was even due they hit my account again and I already had a zero balance. They took out twice the amount that I even owed. They put my account in the negative and caused me to have overdraft fees and charges. Can they legally do this? If any body has any advice on where I might be able to find something out about this please let me know. I have no problem paying my support but takin money that is not there, there has to be a law against this.

In Aus we have free legal advice for low income earners (Legal Aid) if you have a similar service call them as they would be in the best position not only to know the rights and wrongs but also to help sort the mess out/ get compensation fo rthe bank fees.

If the child support was due, they have every right (and a duty) to go after it. The fact that they took "double the ammount owed" is a bit confusing. Call the State's Child Support office and ask why the ammounts were with drawn.
Make sure that you are not a month further behind than you think.

As for the bounced checks and the like, talk to your bank about a line of credit tied to your account. It has helped me from bouncing check more times than I like to think about and I am only hit with a small interest fee.

Did you check with the bank to see if they took the funds from your account twice in error? Banks can make a mistake.

change banks and close the account now while you still have money
