me & my wife have seperated pending divorce, before we split we were about to sign for a remortgage on our house.
that idea was obviously binned upon seperation. Then i discovered that she had signed (forged) my signature on the remortgage documents & had received the cash. i also found that this wasnt the first occasion that she had obtained money by forgeing my signature. anyway during the divorce this has come to light!. I want her prosecuted for this so i went to the police who said that it was down to the mortgage lender Netwast to report it, not me. Even tho the equity of the house has been reduced by this crime & half the equity being mine constitutes theft!. So, i went to the mortgage lender & tried to report it to them & get some sort of result, but NO!. They say that its down to me to report it to the police.
My question is. Who is right?

Get a lawyer and sue her for fraud. File a police report yourself.

This is clearly a case of Obtaining Money by Deception and this constitutes Fraud. You need to report back to the Police station and tell them that you want to make a statement regarding this incident. Once it is in writing, the Police HAVE to act on it.
An officer from CID or the fraud squad will be appointed to the case and an investigation will be made.
Meanwhile return to the Bank and tell them you want to make a complaint to a SENIOR member of staff. You will have a meeting in a private office and the senior member of staff should be making notes of what you say.
The bank will then investigate and if any wrong doing is suspected, the Police will then be involved.

First off what a crappy predicament you are in. My advice, would be don't take no for answer with the mortgage company. I would get that person's name and make them put it in writing. Furthermore if they do not cooperate, you have the ball in your court. File a civil law suit against them for fraud! Then you can get a subpoena for the mortgage documentation and lender that agreed to her getting those assets. I guarantee if you take these steps, they will cooperate. They are just trying to cover themselves or it sounds like your wife knows someone on the inside of the company and they are just giving you hogwash info.
Now to answer your question about the police. You do have the right to press the issue with superiors officers in the department. Let them know if action is not taken, you will file a lawsuit against your local or city sheriff's department, or if you comes down to drastic measures and you really want to stir up some controversy, involve the press.
Good luck and ultimately based on what you have stated in your question, you are right "It is up to you" on how nasty and demanding you have to be towards the mortgage company and or police agency because both have not done there jobs in this matter.

If a crime has been committed and you are aware of it, it is your duty to first re3port it to the police and then to the Building society.
Fraud is a fraud and can only be dealt by police, not the bank or building society, its your word against hers in this situation with the building society, let the police find out all the details.

both are wrong.
Obtaining goods or services by deception is a crime which the police need to investigate, how they go about that I'm not so clear on.
You can most certainly report it yourself, both to the police and to the bank.
You could also sue the bank..... they will soon take notice then......for negligence

I agree you need a solicitor. You can get 1/2 an hour free from some solicitors, just enquire around as to who does this. And as for your wife GET the B***H.

Hire a lawyer or you'll get nowhere. You'll have to sue her for legal expenses she caused you to incur, too.
Good luck!
