A friend of mine is suing her ex husband after she found out he had given her an std prior to the divorce. I do't think he was aware of even having the disease or even believed her when she called and questioned him about spreading it to her. Anyhow, any opinions on this?

It's hard to believe she has a case. After all, how can she be sure he didn't get it from HER, and that she was the one who wasn't aware she had it? And if he did give it to her, how can he be responsible if he didn't know he had it? And how can any of this be proven in court?
It just sounds like vindictiveness to me.

I don't think there is any merit to the law suit. If there were, there would be SO many law suits today, it wouldn't even be funny.

Occassionally, a person can be charged criminally if they intentionally have unprotected sex after they have been diagnosed with a terminal STD, such as HIV/AIDS. (Intentionally spreading the disease) But even those cases can be very hard to prove.

She'll lose unless she has a witness that will testify that he/she heard him say that he purposely gave the disease to her.

Anyway think about it...why would someone TRY to catch an STD just to give it to someone else. That would be psychotic. I'm sure he was just as upset to find out that he had it.

I'm pretty sure it will be thrown out of court immediately. Is the a money-grubbing leech? Even if she thought he did it "knowingly", she would have to prove it. Almost impossible to do.

counting on what the std replaced into.. crab lice..yeah i might desire to forgive him giving it to me plenty extra advantageous than i might desire to the affair.. Herbie's .aids or something alongside that nature i could on no account forgive..

You can sue anyone for anything. But, I do not see her getting a judgement in her favor.

yes u can and can't i'd tell her to go for it! if it's serious it could be attempted murder and he just tryna play dumb.
