I sold my pets to a lady who lives about 10 hours away. She was supposed to mail me a check but lost her check book and mailed cash. It has been over 3 weeks now and I have received nothing and she has my pets. There is no way to track it as she did not use delivery confirmation or have insurance. I don't know what to do. I need the money to pay my rent but I have no way of proving that she did not send it or that I have not gotten it.

That sucks. You got scammed. NEVER allow someone to send you cash by mail. Especially if it's uninsured.

Your only option at this point is to take her to small claims court. Do you have proof of previous ownership of the dogs and any sort of proof of the agreement and price that you set for her? If so, you'll need it. If you don't, you're going to need witnesses. Dig them up, write everything you can possibly remember down with dates of when everything happened and what in fact did happen on those dates, including the day that the woman took possession of the animals.

Witnesses are your only hope unless she's got proof of mailing or you've got proof of ownership and written agreement.

Well she still needs to pay you its her problem if she didnt send it registered mail or insured it. NO ONE ever is suppose to mail cash. If your a breeder and an owner you should have never let the pets out of your hands with out a payment. I always ask for cash up front, before being turned over, and never a check. Sometimes depending on the amount of animals that I had for sale, I would accept Visa or Mastercard. You have been duped. I am sure she never sent any money. You will not see any money at all, you made a big boo boo. I bet you she probably gave you a false address. You can try to take her to small claims court, and be ready to accept all the pets she bought to come back to you. Its a lenghly process and with out any contract its going to be difficult, but in small claims it will be up to her to show proof she paid you. You would likely win. Just be prepared to pay money to the court systems. The deal may be the judge grants that she pay you the money OR she give the pets back. Either way your not getting rent money for now.

BY THE WAY: gms9810 thats seven words not 3. haha. And dont report them stolen to the police cause believe me you will be in more trouble for perjury since you let them go with out a contract or a recipt. The fact is you gave them to her and you are going to get in more trouble than its worth.

Let's hope your landlord is happy you gotten rid of your pets and cuts you some slack on paying the rent. As a landlord, nobody has EVER told me a story like this one. As a pet owner, I can't imagine selling my pets, even to pay the rent. I hope they went to a good if not honest home. Finally as human being, NOBODY sends money in the mail! I wouldn't even have accepted a cheque. You can't put a stop payment on your animals.

oldest scam in the book,nobody mails cash dear! you are way to nice basicly you just gave your pets away,unless you want to pursue it in a court there isn't a whole lot you can do,it is her word against yours unless you have a bill of sale,or you could drive the 10 hours away knock on her door and tell her you want your pets back or payment for them,it is her responsibility that she sent you cash(if she really did)if it was lost then she needs to pay for them again or give the pets back

What did you mail your pets to her? Why wouldn't you get the cash when you delievered the pets or when she came and picked them up??? Besides how can you just sell your pet cause you need rent money?

Anyways, shes gonna have to prove she paid you, or you should get your pets back....maybe you can find someone else to buy them.

Yes, you got scammed. I'd make a police report and file a small claims case. That is the only way you will get your money. You will probably win since she can't prove she sent you money, unless the judge is annoyed at your for giving her the pets before you got your money

Can you contact her? If you can I would contact her and tell her that if you do not receive your money than you will call the police and report them as stolen. In my opinion, taking an animal without paying for it (and promising to pay for it) is stealing.

that is too bad, but it can be a lesson in not taking another living creature and then finding out for whatever reason that you cant handle it. animals have feelings, its not like furniture or something. id just hope that the pets have a happy new life.

It's not your responsibility to prove anything. She needs to prove she hasn't paid. Not sure if you'll get your money, but you did learn not to extend credit.
