if im 15 and have a naked picture of my girl friend on my computer is that child porn. Could my dad get in trouble for it cuz i live in his house

Well, call me liberal or crazy or whatever but I think people are over-reacting.

One picture of your girlfriend. If, at 15 you guys can't have a little fun like that, then I think we should all kill oursleves.

Let's assume the law got involved. Yes, it would be terrible to go through the investigation, etc, but no one would go to jail. 50 years for a 15 year old to have (I assume) a 15 year old girlfriend naked in one pic on your computer... they wouldn't even take it to court - it would be a massive waste of tax-payers money on a case that would be dismissed, or at worst, you'd get some good behaviour bond.

The authorities would only investigate if it became an issue (ie; your girlfriend said that you forced her into being in the picture or something like that).

I can see why some people are saying jail, jail, jail... they likely want to protect you. Just exercise some caution, don't tell your Dad so he can honestly say he doesn't know about it, don't go posting it on the net, or bragging to all your mates, and don't start up a massive collection. I think it'd be less secure having it in your wallet. You're unlikely to loose your computer - but a wallet?

Enjoy the kinkyness as it's all in good fun and no one's getting hurt.

Your age has nothing to do with it. It is the age of the person appearing nude in the photograph that matters. However, for this purpose, we'll assume that she is underage as well. This issue is not as cut and dry as people would assume.

First of all, child pornography has absolutely nothing to do with the age of the person viewing it. It does not matter whether you are 15 or 65, if the person being photographed is under the legal age of 18, then it is considered child pornography.

Now, as to the issue of your father assuming responsibility....Legal officials would have to be able to prove, beyond a reasonable doubt, that your father had seen the photograph, or had knowledge of it's existence. If he uses the same computer as you do, that is enough for the police to arrest him, and the district attorney to indict him on the charge of possession of child pornography. However, chances are, if the computer is in your room, and is accessed by you alone, your father would not be held responsible. You, however, can still be indicted on these same charges, even though you are only 15.

Child pornography is illegal, regardless of the age of the viewer.

I would suggest that you delete the picture if you have already recieved it, and do not save anymore onto your computer.

it doesn't matter if it's YOUR computer and it's in Dad's house..if you try and delete it from the hard drive, it will forever remain in the system, and the next person who gets the computer will find it in the hard drive and get in trouble for just HAVING it on the screen...

And, yes, child porn is a FEDERAL offense(regardless whether you're underage or she is), you WILL go to federal prison for a minimum of 50 years to life and the U.S. Attorney will ask for a harsher punishment for your dad(maybe life w/out parole), PLUS both of you MUST register w/ the U.S. Parole Board AND your local police AND sheriff's office as convicted child molesters!!!...

How dare you do such a sick thing like that on your computer!...what's wrong w/ a Ferrari Dino, or a picture of your state capital building?
