To answer your question, yes, Destiny's Child can be sued.
Not on this claim, though. The Duke Nukem people can try it, but I would be shocked if an IP attorney was willing to take the case.

Anyone anywhere can sue anyone anywhere for anything.
For example I can sue Yahoo because your question caused me immense personal trauma. The suit would probably be thrown out. It varies from state to state but a lawyer who continually brought frivolous lawsuits would be disbarred eventually.
Does not mean they can't be sued.
