that employers use to check past employers comments, dates of employment, etc.? I think I'm being sabotaged by a former employer. Do I have legal recourse if I am correct ? What is the law? Does it differ from one state to another?

Proving hiring discrimination is very tricky . . .they do not have to show why someone isn't hired , and unless they never hire a woman or minority and a news crew sets up a sting operation , you have little recourse.
Most good jobs have many applicants and the employer is free to hire whomever they feel is best. I would follow up with a previous interview , and ask them in a non confrontational manner - " what do you recommend for me to do to improve my hiring chances in the future ?"
If you approach it as a request for assistance, they may shed some light on why you weren't chosen.

Have someone do a background check on your former employers to find out what information is being given out about you. There is no law that prohibits an employer from giving out truthful information about your attendence, violations of company policies, whether or not you gave adequate notice when you left an employer or did you give notice and walk out the same day. All these could be triggers for a prospective employer. The question would be have any of your places that you have applied told you they were checking your background? Have someone call them and ask information about you. Have them verify your dates of employment, job titles. Ask if you would be considered for rehire.
