I started making payments on my student loans and they told me not to file my taxes because they would take it but I nevr got a letter stating anyting can they do that? and now that I started paying dont they have to take me out off of the tax offset?

I did default on the loan and just started making payments again.

If you are defaulted on your student loans, even though you are making payments, it can still be in default. This means if you file electronically, they will probably take your refund. There is a number to call the US Treasury to see if you have a collection or not (800) 304-3107.
If you are still showing as collectible, you can contact a Tax Payers Advocate at the IRS and ask them to make an exception if you have a hardship that taking your refund could make worse.

My husband has a student loan from the Federal Gov't and they have never taken a refund from our taxes to apply it to the loan.

Who told you not to file taxes? Look at your paperwork to make sure it is not written on the paperwork that all refunds will go towards your student loans. If you are not satisfied with the answers they give you, keep going up the chain of command until you're satisfied with what they are telling you.

I've never heard of anything like that. Your taxes are seperate from your student loans, unless something has come along that I'm not aware of. You have to file taxes, and as long as you are making your SL payments, they should have nothing to do with eachother.
