Divorce papers were filed in December 2006. Does that qualify us as legally seperated or do I have to file for seperation also?

No, it is not legally the same. You can file for separation but that is pretty much pointless. Just file for divorce and get it over with. Mine only took a couple of weeks once he signed the papers. Usually when people file for separation, it is b/c they MIGHT get a divorce, from what I understand...

Have you done it yet? Do you have kids? if not, it will be a cheap, quick thing. It's sad really, how fast it's over with. But it makes it easier...

in different states its different. but legally seperated is not the same as filling for divorce. you don't have to legally seperated. if this is about taxes, then it doesn't matter, you still have to file married or married filling jointly, but you have to work together.
