I was involved in two car accidents neither were my fault I was rear ended in each accident. The first guy fell asleep and plowed into me and the second one was a semi who rear ended me. I didnt suffer any broken bones or cuts but I have chronic back pain (honestly) and I am only 22. I have to go through a deposition this wednesday for both accidents and I was just wondering what to expect...I am a bit nervous because I have never had to go through anything like this before and its kinda scary...please help

You'll be asked a bunch of questions... leading questions to cast doubt on your credibility and/or honesty. Also, it depends on what kind of information the other side is trying to gather... Remember, the questions they ask will lead you to their weak points. They may want you to say something to the effect that you slammed on your brakes, or did something to cause the accident(s). There are people (dishonest) that remove their rear brake lights in order to assist in getting rear ended!

All they are going to do is ask you several questions concerning the accident. they will also ask you about the back pain--------back pain is very hard to describe-(mine's been broken twice)I definitely know what pain is, however there are some days worse than others(which is normal)Whatever ya do dont ever tell them you have felt no pain at times--------always tell them I have my good days and then I will have bad days ----they will ask you to describe each. You NEVER tell them you have no pain what so ever because this IS WHAT THEY WANT TO HEAR,you could not have any pain for several days in a row then all of a sudden you could have severe pain for the next 6 months day in/out.I had my accidents over 30 yrs ago and there are times, even to this day I know what the pain is from.

If you don't have a lawyer, get one. Opposing council will use that deposition against you in any way you can. When telling the truth, the versions usually differ--attorneys use this against people in court. I hope you are under treatment. Even soft tissue injury can take a very long time to heal.

An attorney is supposed to be there and help with this - with that type of accident, do you not have one?

I strongly suggest not trying to handle a case such as this pro se (representing yourself).

You should consult with an attorney right away and explain your deposition is a day away.

If you dont know that answer to something dont guess. Just say I dont know. They will try to corner you and make you seem at fault. Try to remain calm and dont let them make you nervous. You'll be fine. Good luck
