My company is now starting to pay overtime even though i am salary paid at the end of each month. But they have said that if you work overtime at the beginning of the month, ie 12hrs x time and a half and then have 2 days off sick at the end of the month i will not be paid my overtime rate because i have not worked enough hours in that month.I will loose a half days pay in this example.Is this legal?

i believe it may be legal....

i once ran a huge warehouse for a food company and the policy there was overtime started after 39 hrs worked in the week as opposed to after 8hrs in the day..

so they may well say overtime can be accrued after the months hours are reached even tho you may well work say 52 hrs for 2 weeks and then 40 and 2 days sick no overtime...

Probably, working wages & overtime laws apply to hourly workers.
Salaried people have contracts that supercede the hourly wage laws.
Re-read your new contract regarding the overtime , your definative answer is in the contract.

No, it's not legal. The company must keep these items separate.
