Are you asking about state taxes ? IDK
Fed ? You could probably file joint but ask the ones that actually know . . .

To file jointly means you are married. Marriage by common law in most states means living together for 7 years. I would definately file separately.

As far as federal taxes go married filing jointly does NOT qualify for non-married living jointly no matter what you want to call it
