She is married to a man is the army who is currently being deployed. We live in California, she is in North Carolina. This deadbeat hasn't paid a dime! Will the military help since she receives his check? Also she is running a daycare out of her home? How can we collect what the children deserve?

Take her to court. It is the only way.

You'll have to call your child support government office, and inform them about her running a daycare and such in the state she's in. They can then pursue it with North Carolina to threaten to suspend her license for Daycare, and they can also take her into court and have her jailed if she owe's more than $5,000 dollars in back childsupport. It's a felony if she's $5,000 or more behind.

Her husbands paycheck from the army will not be attached because of her childsupport obligation he didn't father the kids and thus shouldn't have to pay a cent.

If this is court ordered child support, she will have to be taken back to court - which seems like nearly impossible considering your situation right now. You can file against any income tax refund she may be due, perhaps have any wages garnished. In the state I live in - unpaid child support results in the state suspending driver's licenses which makes the offender subject to arrest and jail time. The best plan may be for an attorney be involved on your behalf.

You will have to go to Child Support Enforcement and file a complaint with them. Generally you can take the non-paying parent to court and have them compelled to pay support or face garnishments, fines, and possibly jail time if they still refuse to pay. Some states even go so far as to revoke their drivers licenses, and intercept their tax returns, and put their faces up on a billboard for everyone to see. If she lives in North Carolina you could contact her husbands base commander and file a complaint with him. Her husbands base commander will most likely kick over the his company commander, or refer you to their JAG department. Try going to www.military.com and looking for her husbands unit and such. That website has a wealth of information in regards to base commanders, company commanders, and JAG departments. If you have an attorney they should be able to assist you in dealing with the child support issue. Good Luck

First of all u cant touch his military check so get that out of ur mind.. he is not financially responsible for the child, she is..

As far as running a daycare out of her home..u are entitled to her income..

I would contact child support enforcement in California, u fill out the application, turn it in, they send it to the state of NC..and they will force her to pay, and if she doesnt they will take her Tax refunds, Suspend her license.. put liens on any property she owns ect.. usually its just 25.00 to file for and then just waiting your turn..

With a Court Order the military will deduct from pay, and unless there's a prenup (god I hate that word, if people are sure they're going to end up divorced they should never marry) the military will hold him responsible for her bills.

Contact the Attorney General they should be able to help you guys with collecting this child support.

If it is stipulated in the divorce decree, she's in contempt of court.
Speak with an attny. In addition, ask the attny about her federal tax returns. If she receives funds back, something if not all should come out of her refund.

the best thing to do is get a lawyer. And you can request that the other party pays for all the legal fees.
