my sister in-law has had on going problems with her husband of 4 years. problems regarding settling down and getting a stable job. anyway things are not going well with them, and she is trying evrything to make her marage work, but he totaly doesn't get it. he just wants evrything his way. and does not care about resonsabilities. And so now he want to go to Cali. to live with his mom and take his son with him and leave his wife behind. they curently live in Arizona. She thinks otherwise. sereous answers plz.

She would have to file for child custody. If he takes the child without the mother's consent or approval she can declare this as a kidnapping. There are attorneys out there who will file a family suit regarding this. It doesn't matter if the child left with the dad. What matters is that both parents consent to where the child will go and live.

I doubt he will be able to take the child. A court will look at his work habits and find that he can not take care of his self let alone a child. Where I live the man has to commit murder for the court to take a child from its mother.
If counseling is out of the question, get a lawyer now and fast.

Not going to happen. She can fight for custody and if she's working and providing and he isn't then she'll most likely get the child.
