Regarding civil lawsuits, when you go to court- where do u get the paper work done. In other words, to who do u go to, to receive that paper. And, let's say the person did not confide in a lawyer to get the paper work done. Any kind of help will b much appreciated, Thank you!

The papers that you refer to are called a summons and complaint. Basically what the papers contain is a statement of
jurisdiction and venue, which declares that this court is the proper place for the suit to be heard. Then comes the statement of the facts, basically who did what to whom, and a summary of the supporting statute as well as their damages. Finally, there is a "Prayer for Relief", in which you ask the court to award you the damages set forth in the complaint. Along with the complaint goes a proof of service, showing that the defendant was served a
true and correct copy of the summons, as well as a notice of the time and place of the hearing, which serves as a cover sheet.

You don't go get paperwork. It is prepared by someone qualified to prepare it. If you want to do it yourself, head to your local law library and look up first the Rules of Civil Procedure. Then look up the forms you need. Then look up the filing fees and who is qualified to serve process of the documents. It's not an easy task and many of us in the legal profession have been doing it for many years.

There are some certified document preparers that cost less than an attorney, but in the long run, you are better off starting the case with an attorney.

Get a lawyer. You have to file pleadings etc. The clerk can't give legal advice. There is really no form per se. It all depends on the rules of civil procedure and if it is a civil rights violation that would be the federal rules of civil procedure.

You don't have to get an attorney, go to your local courthouse and ask for the civil lawsuit paperwork. Now, if it gets to a certain amount (I think it's over five thousand) then you'll have to get an attorney. But if it's not, just go to the courthouse.
