You would have to contact a lawyer, if you don't have the money you might be able to have one appointed. Contact your local courthouse and see what they can do. In turn the lawyer would have to contact the state of your nephews and set up a court date to hear your case. I'm sure you would have a good chance because you are family. I have never been in Foster Care or known anybody that has been or has children in Foster care, but I would suggest contacting the children's Social Worker and explain to them that you would like to take care of the children. Just like adopting children you have to prove that you are responsible enough to care for these children and do everything in your power to make sure they have a safe home and a family that loves them. You may also have to promise the Social Worker that with the children in your care that you or the children will not have contact with their birth parents, even if it means not going to family functions or excluding the parents from family functions. I am not an expert and I apologize if I did not help, but I am adopted and those are things that adoptive parents need to prove to adopt children.

first you have to go to the state where the children reside and file a motion a motion to intervene. If the courts accept you as an interested party then you will be allowd to seek custody. I strongly advise you to consult with an attorney but there is a woman in Colorado who was able to get her grandkids out of foster care only because she was able to change the laws. You need to talk to the child services department in the state they live in. Tell them that you want to take care of these kids and they will give you direction on how to go about filing the paperwork for custody. Good luck to you.

first contac their social worker, at social services ask them what you need to do for your specific case. It would be much easier if your brother and wife sign the papers for you to have custody of them, but if not, being that you are family, you will have to deal with department of social services of the state the children are in.
since you don't say what state you are in and they are in, i cannot help further. some states might have different rules.

File a petition for custody and get a lawyer to help you out. It's most likely you can get the kids because you are family and kid a better off with family.

File a petition with the state they are in foster care with. you are a relative and the state would rather a relative take them (if you are qualified) to pay for them rather than the state.
Oh and tell your brother and his wife to stop procreating.

You would probably have to go to court, and fight for the kids. and they probably want proof that you can take care of them, and give them a good stable home. contact a lawyer good luck.
