Apparently 20 states have adultery laws. (I couldn't find a defined list of those states) The laws are rarely enforced.

"In more than 20 states, adultery remains a crime for which one can be prosecuted by the local district attorney."

"The enforceability of criminal sanctions for adultery is very questionable in light of Supreme Court decisions since 1965 relating to privacy and sexual intimacy, and particularly in light of Lawrence v. Texas, which apparently recognized a broad constitutional right of sexual intimacy for consenting adults."

Personally never heard of the law but anything is possible. I do know for fact that you can sue anyone anytime for any reason and if you can present a real good believable story to the judge you stand a pretty good chance of winning. It would be really interesting to see what the actual law suit read as to how she got it into court, but I guess she was right if she won.

If it is not I sure hope it becomes one.. Sounds like a good law to put into action and to enforce... May cut down on alot of cheating and affairs which would be a good thing!

certain states DO have laws that do pertain to situations like this. Regarding affairs etc. etc. it really depends on the extent of the situation though.

They have to prove beyond reasonable doubt that he was very happy in his marriage before the affair and that there were no problems.
