We paid an atty $500 to get a DNA. My brother was murdered and the state has his dna. you can look at my question I posted before this one to read more about this. anyway, We had an appt with the atty this morning and I wanted to see proof of what he had filed. He pulled a case up, and gave me a copy. The names for the dna were wrong, My brothers name is Robby Brown, He had Robert Brown, and the case # on the paper was a divorce!!! We went immeadiatly to another lawyer and showed him, He gave us the the complaint to the bar papers, and said to get your money back.I am so upset, we have been waiting to see if this little girl is my dead brothers daughter, the only thing we have left of him. She is in a foster home, and when we hired this lawyer he knew the foster family was wanting to adopt her...Can I file a police report? I cant believe this guy did this to us knowing our circumstances...I am so hurt and dont know what to do, I just hope our time is not up

Try the local Bar association first and see what they advise

Unless there was criminal activity that occurred on the part of the attorney, then I'm not sure how useful this would be to you.

Suggest you file an ethics violation with the state bar. This is really the best way to get something done. The state bar takes every complaint seriously and if they determine that there was a violation and it was severe enough, the attorney in question could be disbarred.

I'm very sorry for your loss and hope that you find resolution. Contact the state bar. They will help you.

The police most likely will not even file a report. You voluntarily hired the lawyer, unfortunately. Some lawyers are very fair and conscientious and will give you what you paid for. I have experienced negligent, careless and unethical lawyers during my travels. Best to make a formal complaint with The Bar Association in your state- I've done it and The Bar will have a file opened and investigate your complaint swiftly. Lawyers are "public servants" - officers of the court and have an ethical, moral obligation to the public.

Lawyers are one of the very few unregulated practices in the world!

This is a civil matter. What the lawyer did was a breach of the rules of professional conduct in that he exhibited gross negligence in the performance of his duties. Bring an action against him for malpractice of law, that way you can recover the fee that you paid him.
The other matter will turn on whether not the adoption has become final. If so, courts are very reluctant to disturb family arrangements, especially when these are the only parents that the child has known. On the other hand, if the adoption is not yet final, you can petition the court which is handling the matter to grant custody of the little girl to you. Question: where is the childs mother? What does she say about all of this?

a police report is not going to get you very far. Legal action against the attorney will. That's why the other atty gave you the papers.

If you can still prove familial connection the game may not be over with the adoption.

I agree with Jeffrey, this is a civil matter. The standard of proof is also less in civil court - you just have to tip the scale so to speak.

Remember, unless an attorney takes a case on contingency, they normally charge by the hour. This can get very expensive very quickly. Before I initiated any litigation, I would ask myself what I hoped to gain by it and then act accordingly. In the meantime, the grievance process costs nothing.

The bar complaint form given to you by your new attorney is likely your best recourse, because you are interested in complaining that your attorney was incompetent. This might lead to you receiving your money back, and possibly disciplinary action against your attorney.

Unless you have evidence that your attorney has committed a crime (rather than merely being incompetent), there is no basis for a police report.

I certainly would have charges brought against this attorney; the sooner the better. In addition you have to report this to the Bar association asap. What he has done is fraud-misrepresentation of his powers of attorney. This is most definitely against the Law no matter which country you live in. Get this done asap before the next court appearance. I would also sent a report to the court appointed judge so this can be settled before the next court date. Good luck, and God Bless!!!!!!!!!

'm not sure if you can file with the police but you can turn him into the bar association so that he doesn't do this to anyone else. In fact i highly recommend it.
