My husband got fired from his job of 7 years two weeks ago.
It was his fault, they made him work 16 hours strait and he was tired so he didn't do proper preformance on his patrol (Security)
We went on vacation, and when he came back his account manager said not to go to work and come to her office the next day to find out why.
They had reviewed tapes and he didn't do anything for the last 8hrs of his shift because he was tired.
The reson the reviewd tapes was because something happen the week he was gone, and they did everone,and fired a couple of people and wrote up the rest for job preformance.
My question is now he is reapplying and he doesnt know what to but for reason leaving.. I know fired is bad is there a word you can use to work around being fire.

Unless he lied to me...

He said that he walked around the inside of the building, but when he went outside he smoked and came back so no outside patrols for the eight hours.

the thing about the court comment, why should he go to court when the thing happened when we were on vacation, so it was the officers of that day who would go to court, dont you think. I mean nothing happened when he left work that day.

This also depends on the state labor laws. For security, 16 hours straight shift is not reasonable. Second, He was on vacation of the incident. It seems that the company has a lawsuit on its hands.

On applications, I would place a spin about being fired. HR is required to give name rank time of employment and termination.

This is not why the person is fired.

He should be honest and list it as "termination". That word conveys many different reasons for leaving, but will leave room for him to explain why he was terminated if he receives an interview. Advise him never to lie about it, since all job applications are legal documents and her could be dismissed on a new job if caught lying.

Legally the previous employer can only state the dates of employment, pay rate and position. They can not tell the prospective employer that your husband was fired. If they do they could be held legally responsible.

You can call the previous employer or have a friend call and ask about your husband as if you were going to hire him. That why you can hear what the previous employer had to say.

Depending on where you live you may also have legal recourse against him being fired that way. It varies from state to state. If he was forced to work those hours and made an objection beforehand he may have a case. Most states are right to work states and no recourse would be available. You should contact your state dept of labor to find out for sure.

Terminated is also a substitute word for fired. But he didn't do anything for the last 8 hours ??? I could even understand 2 or 3 hours at the end of the shift being slow or reduced... Did he call in and explain during his later shift? Was he out back smoking pot for 8 hours?

Somehow you gotta do as alphabet soup suggested in earlier reply, you need to spin it into positive for the company and positive for him provided it really is.

Somehow, I don't think we have all the facts, but I do wish you both good luck.

Instead of fired, call it 'released'. Spin it in a positive light, don't blame the company with negative comments, mention it as a learning experience with different expectations.

You can say job ended. The important thing is to tell the truth and what the situation you learned. Have faith. It is hard to personally get over it.

if they let other people go at the same time, he could try to spin it to make it sound like they were just cleaning house (doing layoffs)

Your husband is no better than a thief for sitting around on company time for 8 hours. He should be thankful the company doesn't take him to court.
