As general information only in the United States, a summary judgment is when the court has made a legal determination without trial. Absent a dispute of facts or a legal defense, a party can request summary judmgent from the court.

A purely hypothetical example: Car A was sitting at a stop sign. Car B hit the back of car A. In the legal jurisdiction where this hypothetical case is, a rear-end collision is the fault of the car that rear-ends the other vehicle absent a legal defense. It is not disputed that Car B hit Car A, and no legal defense has been offered by the driver of Car B. The person in Car A (or his insurance company) moves for summary judgment. Because no defense has been offered, and the facts are not in dispute, the motion is granted.

Please note that people often confuse summary judgment with default judgment. Default judgment is where a judgment is granted because the defendant never files any answer to the original complaint
