I just started a small business in Florida. The legal name of the business has ", Inc." on the end (XYZ, Inc. for example). I'd like to do business without the ", Inc." (XYZ).

Am I required to file for a fictitious name just to do business without the ", Inc."?

Just to clarify, I'm not trying to drop ", Inc." from our legal name - just want to promote the business without it.

Anytime you do business in any name other than the legal name it is a good idea to file a fictitious name with the SOS (Sec of State) or local county clerks office. It's more to protect you from someone else doing the same and trying to use your name for their business. Depending on what you are doing as a business the "Inc" can become an advantage in and of itself, especially if your business is in the area of B2B (Business to Business).

If you are legally Sam's, Inc and you want to do business as Sam's there is probably not a problem except for the unscrupulous competitor as mentioned above.

On your legal and financial documents it needs to be included to indicate the businesses classification type, but you can promote yourself without it without any repercussions. I use it when I have to sign a legal document or bank document. Remember, when you sign something on behalf of your business to use your title and the name of the business or you are liable personally.
