recently there has been a pitbull loose in my neighborhood..i've called animal control on it three times..this dog has attacked my dog that is chained...animal control seems to not be doing their job..after the attack i called and they said they would look for the dog.even though they know who he belongs to. They go around the neighborhood once then leave. just this weekend the dog was loose saturday at 6am, then sunday at 7 am with a boxer snd then later in the day with atleast 5 other dogs..couldnt call animal control then because they dont work weekends..just had to run the dogs off..if something bad happens to my dog like a death i plan on sueing the owner of the pit, but would i also be able to sue animal control? the thing that gets me is Animal control know who he belongs too, they've had problems with this dog before..so why arent they going to the owners? animal control in ran by the police department here..so the police know..they have been called to our house too about this dog..he said there is nothing he could do but try to locate the dog, even though he could catch it or anything..this was a Saturday that animal control wasnt working.

Oh and the only reason Champ in on a chain is because we are renting right now and not allowed to bring him inside and they wont allow us to put up a fence..thankfully we're moving in few months.

No you can't sue animal control. Just like you can't sue the police for not coming to your aid fast enough.

It is VERY difficult to make a case against animal control, being a part of the government. And since it seems that they are not going to do anything, here is the following, if you are truly serious about having something done.

Call the local police, tell them you need an officer to assist you in making a citizens' arrest. Then take the officer with you, go to the owner of the dog, and with the officer's assistance place him under arrest for "willful endangerment". Do NOT try this alone as the fool who lets the dog run will probably assault you.This will mean that you will have to go to the lockup with them, press the charges before a magistrate, appear in court to press charges, and generally be tied up in the mess for a LONG time. The other party will most probably back down by then, but you cannot assume that he will, so be ready for court time and possibly a counter-suit.

Try calling the mayor or city comptroller and complain about animal control, it might be a better way than the above.

shoot the dog........problem fixed. If a stray dog attacked me, my family or my pets it would find a quick end on the bad side of a wood axe.
