My son was driving to work down a highway where the speed limit is 55 mph but he had kicked it up to sixty. A young kid started tail gating him. He slowed down to give him the message to get off his tail but he got so close to my son's car that he couldn't even see the front of his car. So my son speeded back up to 60 thinking the kid may get the message but he continued to follow closer and closer. Suddenly a cat ran out in front of my son's car and without thinking about the kid tail gating (and liking cats himself) my son slammed on his brakes and the kid lost control of his car, skidding sideways going up on two wheels and ending up in a ditch. He got out of the car shaking his fist at my son who simply drove off. My son was afraid that HE would get in trouble but I don't see how. He didn't stop because he could see the kid was okay but that he was very angry. Was the accident his fault or did the kid get what he deserved?

My son didn't know the kid, is young himself and after the incident he felt he had to take a different route which took him longer to avoid the possibility of seeing the angry kid again because he was afraid of retaliation.

it was the tailgater's fault...

i don't blame your son for not stopping... if the dude was shaking his fist... that could be taken as a threat, therefore giving your son reason to believe that the guy was okay and if he had stopped the dude might have tried to take his anger out on him...

hard lesson learned for the tailgater...

it's NOT a hit and run if the tailgater didn't actually HIT the back of your son's car... so, he didn't commit any crime...
however, i do believe that when you see an accident you are required to stop and render aid...

HOWEVER... it was pretty obvious that the dude was okay because he was p!ssed off and shaking his fists at your son... no need to really stop in my opinion...

Dragon doesn't think yer son could possibly be at fault. The kid doing the tailgating was completely at fault fer being an IDIOT while driving. He deserved to end up in the ditch after that. Yer son is prolly right to have not stopped to check on the kid, and is prolly bettar off taking a different route fer awhile.

You didn't say yer son had actually been HIT by the other kid. If there was no contact between the two vehicles, it was no hit-and-run accident.

Well there are two faults here. The other kid for tailgating and your son for slamming on his breaks to avoid a cat.

First rules of driving school tell you that you never, ever stop to avoid hitting an animal specifically for the reason that happened to your son.

Just be glad everyone was okay. It could have been a lot worse.

with the exception of distracted driving, there's nothing as pointless as tailgating. does getting to your destination a 1/4 of a second earlier (if you DO get there at al) really matter?
but your son, did, in a sense, leave the scene of the accident, but who's to prove that he was involved, even with witnesses? that would just be a "he said, she said" incident. i'd have driven on, sorry. the possible road rage resulting from him stopping could have been even more dangerous.

The accident was at fault to the guy following too closely. However the moment your son left.. the accident then became a hit and run.. even though your son was not at fault.

:( But as long as everyone is okay.... that's all that matters.

The kid's fault, but your son shouldn't have left the scene of an accident.

Tail gating is illegal as far as i know... but then so is speeding. 50/50.....i wondered if your getting the true story, it sounds fishy to me.

the guy who hit your son, friend is a state cop, if you hit someone from behind its always your fault, even in a chain reaction wreck.
