You need to see a local attorney that handles worker's compensation cases. Here in California, failing to have worker's comp insurance would allow the worker to sue in superior court, where the benefits are much higher than in the worker's comp arena.

Get a lawyer and sue because as your employer he has to have some kind of insurance to cover accidents on the job!! GOOD LUCK !!

Most states require employers with more than a handful of employees to carry Labor & Industry worker compensation. If he doesn't then he's at fault and you should sue him for the bills.

If you are employed as a sub contractor and you don't have any taxes taken out. you are on your own
