Hi, I need some info on being extradited . my sis got picked up in West Virginia but charges are from Pennsylvania they are misdemeanor charges as listed for WV. the charges as far as i know are just warrents for probation and child support. i want to know if she WILL be extradited on just that and how long it could take before she gets back to Pa ? Any help would be great !

Yes she can, but only If Pa feels it is WORTH the transport. Sometimes, it just isn't worth the cost of an officer to come and do an intrastate pick-up, so WV would just release her on her O.R.

Just my humble opinion based upon experience, however, if this warrant is for a probation violation...my best guess is that the State of Pennsylvania will extradict.

As many have already said, however, often times a warrant is for an offense where the State places limitations upon how far they will extradict.

You can find further information by contacting the District Attorney's Office from which the warrant was issued.

the DA from the court that issued the warrant makes the final decision, and 5 days she has to be held, if after 5 days she must be released but can be re arrested right then for another 5 days, so she should be moved within 10 days or released. If it is a probation thing then she probably will be extradited.

No, they wont as LONG as she has a good lawyer that will help her. They are not big ones like Murder in any degrees or Rape cases.

its up to the court and your sister's lawyer some times you can fight it..
